Think you have been overcharged?
We have received a number of calls from ex-clients of a Sydney law firm that had been in the news a lot lately for all the wrong reasons. They have called us to see if there was anything we could do about what they had been charged by their previous solicitors. If their bill was less than twelve months old we have been having the costs assessed but if the bill was more than twelve months old this was not an option.
To help these people we had to come up with a different strategy. What we decided to do was take court action against the previous solicitors for overcharging in breach of their legal and ethical obligations. The first of these cases just came up for hearing and has been finalised on very favourable terms
It involved a lady who was injured in a motor vehicle accident in 2003. She was a passenger in the vehicle and the insurance company admitted liability. Despite that the law firm in question charged her a total of $73,031.60 in costs out of a total settlement of $120,000. We calculated that all they were entitled to charge was about $15,000.
In the result the firm agreed to pay back all the costs they overcharged, together with interest and in addition they paid all the costs of the case. They paid in total $140,000.
The significance of this case is that we can now challenge any bill issued in the last six years not just those in the last twelve months.
