FIRTHS SECURES $10 MILLION TPD SETTLEMEMT

Firths The Superannuation Lawyers have achieved what is believed to be the largest ever settlement in an income protection and TPD case. And to make matters even better, because the claim made was for damages the entire amount was completely tax free!
The client whose income protection benefits had been suspended came to us only after he had spoken to several other firms none of whom advised him that he could potentially entitled to millions of dollars in tax free damages.
As the insurance company was only prepared to offer $3 million we advised the client to take legal proceedings.This was not something that the other firms he had spoken to were prepared to do. However he took our advice and the matter was ultimately settled out of court at a mediation for $10 million.And because the case was pleaded as one for damages the whole amount was tax free.
With the client on board we commenced proceedings in the Supreme Court and rather than face almost certain defeat the insurer caved and agreed to pay out the $10 million.
